Wrongful Death Claim Possible After New Jersey Car Accident
One of two fatalities recorded within 11 days on interstate highways in New Jersey appears to have resulted from the actions of a drunk driver. Both of the fatal New Jersey accidents happened in May, 2014. A wrongful death claim could be forthcoming in the aftermath of this tragic incident.
This particular motor vehicle accident happened during the early hours of a Sunday morning. An allegedly intoxicated driver lost control of his vehicle while travelling north on the interstate. His car hit the center median, spun out of control and eventually came to a stop across two lanes of the highway. A 49-year-old driver was also travelling north when he struck the intoxicated driver’s vehicle.
After the impact, the 49-year-old man got out of his car to see what happened. At this point, another vehicle stuck the victim. The victim passed away about 40 minutes after being hit at the accident scene. The deceased man’s wife and the drivers of the other two vehicles were treated for minor injuries at a local medical center. According to the police, the driver of the car that initiated the crash was charged with DWI and could face additional charges.
The family of the deceased victim in this fatal motor vehicle accident may have the right to file a wrongful death claim in a New Jersey civil court. Financial damages can be awarded in these types of civil cases when there is a sufficient amount of evidence suggesting that a victim’s death was caused by the negligence of another party.
