Fatal Motor Vehicle Accidents: Charges Filed Re Cyclist’s Death

The victim of an alleged drunk driving accident passed away as a result of the head injuries he suffered in the crash. Driving under the influence often causes fatal motor vehicle accidents when a larger, enclosed vehicle collides with a bicycle. In this tragedy, a 61-year-old New Jersey man was struck while riding his bike in Bergen County.

The accident caused the victim to fall and hit his head on the paved surface. He was transported to a nearby hospital, where he passed away two days later. The driver was originally charged with assault by auto.

Since the victim passed away, the charges had been upgraded. She now faces a vehicular homicide charge and more charges may be possible. Although the driver was out on $15,000 bail regarding the original charge, she was expected to return to court on May 12 with respect to the vehicular homicide charge. Bail is expected to be raised to a cash amount of $125,000.

Regardless of the outcome of the criminal case, the estate of the deceased cyclist may choose to initiate a wrongful death lawsuit against the accused driver. In New Jersey, surviving families of victims of fatal motor vehicle accidents may seek legal redress in a civil courtroom. In such a claim, financial damages for wrongful death may be awarded upon sufficient proof of negligence, and a conviction secured in criminal court may support that attempt. Should the claim be successful, the surviving family may find that any money awarded could provide them with some relief as they struggle through an understandably difficult time.
