A 41-year-old woman died just after midnight on a Monday in late March after a fatal car collision. The victim was hit on East Commerce Street by a black Dodge driven by a 29-year-old male. Auto-pedestrian accidents like this one illustrate the dangers for New Jersey pedestrians at night.
Very little information is currently available regarding the accident. Police report that they received a call at approximately 12:30 a.m. informing them of a car hitting a pedestrian. It is reported that the car was traveling in the eastbound lane when it hit the victim. The victim landed in the opposite lane.
The paramedics first on the scene called for a medical evacuation helicopter, but shortly thereafter cancelled the call, as the victim died at the scene of the accident. The accident is still under investigation. No further information regarding the accident is available at this time, but that could change when authorities make an official report available.
A tragedy such as this accident generally leaves the family of a victim devastated, while at the same time having to face financial hardship. Not only will they have to pay burial and funeral costs, but cope with the loss of income due to the accident. However, should it emerge from an investigation into the accident that the driver of the black Dodge acted negligently, the surviving relatives of the deceased may elect to initiate a wrongful death claim.
In New Jersey, surviving family members of the victims of auto-pedestrian accidents may elect to file a wrongful death claim in order to recoup damages resulting from the accident. Successful wrongful death civil claims provide for the reimbursement of any monetary damages. The court may award monetary damages in a successful claim for funeral and burial costs as well as other related costs.
