New Jersey Personal Injury Statutes of Limitations

As with most civil lawsuits and criminal charges, personal injury claims must be filed within a certain time period to be legal in New Jersey. This concept is due to what is known as statutes of limitations laws. For those who fail to file personal injury claims within the established period of time, their case will likely be thrown out and the opportunity to recover financial compensation will be lost for good.

It is important to understand that the start date of these time periods can be adjusted depending on the exact nature and circumstances of your case.   • Medical Malpractice injuries sustained at birth – victims may be eligible for legal action on their 18th birthday
  • Wrongful death -two (2) years
  • Breach of contract – between 6 and 16 years
  • Property damage – six (6) years
